Import rules
No state monopoly on spirits importation. Commercial imports from non-EU countries require an EU-established importer of record with an EORI number and customs clearance via the SAD (Single Administrative Document). Spirits packaged for domestic retail sale must be affixed with an official Hungarian fiscal tax stamp (zárjegy) issued by NAV. Importers must comply with the mandatory Deposit Return System (DRS / MOHU Repont) or Extended Producer Responsibility (EPR) reporting for beverage packaging.
Import duty on spirits (HS 2208)
Spirits imported under HS code 2208 from third countries are subject to the EU Common Customs Tariff (typically 0% for whiskies, vodka, rum, and gin under WTO tariff agreements, or specific rates per hectolitre of pure alcohol for certain categories if originating from non-preferential countries).
Excise and taxes
Distilled spirits (alkoholtermék) are taxed under Act LXVIII of 2016 at a base rate of HUF 565,840 per hectolitre of pure alcohol (approx. HUF 5,658.40 per litre of pure alcohol), subject to statutory valorisation (inflation indexing). Standard Hungarian Value-Added Tax (ÁFA) of 27% applies to all retail sales and imports of alcoholic beverages.
Retail and distribution
Private retail model: supermarkets, hypermarkets, specialized liquor stores, convenience stores, and HoReCa venues (bars, clubs, restaurants) may sell spirits. State-concession tobacco shops (Nemzeti Dohánybolt) are also licensed to sell alcoholic beverages. Local municipal councils have statutory authority to restrict late-night off-premise sales (frequently between 22:00 and 06:00).
Online sale and delivery
Allowed for licensed businesses. Distance sales and online delivery of alcoholic beverages are legal, provided robust age-verification mechanisms are enforced both during ordering and at the point of physical handover (delivery must be refused to persons under 18).
Labelling
Labels must comply with EU Regulation 1169/2011 and Regulation (EU) 2019/787: mandatory legal sales denomination, actual alcoholic strength (% ABV), nominal volume, lot/batch number, producer/bottler or EU importer details, and allergen statements (e.g., sulphites > 10 mg/l) in Hungarian. Spirits for Hungarian commercial retail must bear the NAV fiscal tax strip stamp (zárjegy). Packaging must carry DRS/EPR marking where applicable.
Advertising
Regulated under Act XLVIII of 2008 on Commercial Advertising. Ads cannot target minors, feature actors under 25, associate alcohol with driving, therapeutic effects, sexual prowess, or physical/mental enhancement. Tightened restrictions prohibit alcohol advertising in public education and healthcare facilities and within 200 metres of their entrances, including outdoor signage and retail display windows facing public areas.
Legal definitions of spirits
Directly governed by EU Regulation (EU) 2019/787: Whisky/whiskey (min 40% ABV, grain mash, oak aged >= 3 yrs); Rum (min 37.5% ABV, distilled from sugar cane products); Vodka (min 37.5% ABV); Gin (min 37.5% ABV); Brandy / Weinbrand (min 36% ABV). Hungary strictly protects its national Geographical Indication 'Pálinka' (min 37.5% ABV, 100% Hungarian fruit, no added neutral alcohol or flavorings).
Dry or restricted areas
No dry towns or administrative territories. Local governments (települési önkormányzatok) frequently enact municipal decrees restricting off-premise alcohol sales during night hours (typically 22:00–06:00) and prohibiting alcohol consumption in specified public places (parks, public squares, near schools).
Recent changes
- Introduction of statutory valorisation (inflation-linked automatic annual adjustment) of excise duty rates on alcohol and fuels under Act LXVIII of 2016 starting from 2025.
- Tightened advertising restrictions enacted prohibiting the display and advertising of alcoholic beverages within 200 metres of educational and healthcare institutions, extending bans to retail display windows visible from public thoroughfares.
- Nationwide rollout and enforcement of the MOHU mandatory Deposit Return System (DRS) and revised Extended Producer Responsibility (EPR) regulations covering single-use beverage containers.
Opportunities for exporters
Hungary's spirits market demonstrates robust consumer interest in premium and ultra-premium imported spirits, particularly craft gins, aged rums, single-malt whiskies, and specialty liqueurs. Exporters that partner with established Hungarian distributors equipped with excise warehouse infrastructure and NAV tax-stamp clearance capabilities can navigate the high VAT and excise regime effectively.
