Import rules
Alcoholic beverages are classified as prohibited goods under Annex 2 of the Customs Tariff schedule and federal import regulations. Commercial consignments are confiscated at ports of entry, and importers face criminal prosecution and fines under the Customs Act 2020 and the Penal Code. Entry is permitted only for non-commercial consignments cleared by accredited diplomatic missions.
Import duty on spirits (HS 2208)
None; commercial import of HS 2208 is prohibited (no tariff rate is applicable; tariff schedule indicates non-entry for commercial goods).
Excise and taxes
Not applicable; no excise duty, VAT, or sales tax mechanism exists for commercial spirits because all commercial transactions are illegal.
Retail and distribution
Banned; there are no legal retail shops, liquor stores, or licensed bars anywhere in the country.
Online sale and delivery
Banned; any sale, supply, or distribution of alcoholic beverages is illegal.
Labelling
None established for alcohol, as commercial distribution and marketing are prohibited.
Advertising
Banned; advertising or promotion of alcohol is completely prohibited under Islamic law and media regulations.
Legal definitions of spirits
Article 417 of the Somali Penal Code defines an alcoholic beverage as any beverage containing an alcoholic strength exceeding 3% of proof spirit. No commercial standards of identity exist for individual spirit categories.
Dry or restricted areas
Entire country is dry under national law and Sharia across all Federal Member States (Banadir/Mogadishu, Galmudug, Hirshabelle, South West, Jubaland, Puntland) and Somaliland.
Recent changes
- Full implementation of modernized customs declaration processing via SOMCAS under the Customs Act 2020 and 2024 Customs Regulations, maintaining alcohol on the strict prohibited goods register.
- Ongoing interdiction and strict port enforcement at Mogadishu, Bosaso, and Berbera affirming zero tolerance for unapproved alcohol imports.
Opportunities for exporters
There are no commercial opportunities for alcohol exporters in Somalia due to absolute prohibition. The only legal destination for alcoholic spirits is restricted non-commercial supply to diplomatic missions and foreign military/peacekeeping contingents under international exemptions.
